Santa Clara County District Attorney releases statement on Foster ruling

A Santa Clara County judge ruled on Wednesday that there is insufficient evidence to proceed with the domestic violence charges levied by the Santa Clara County District Attorney against 49ers linebacker Reuben Foster, for an incident with his ex-girlfriend on February 11.

The weapons charge against Foster has also been reduced to a misdemeanor. A pre-trial for those charges has been set for June 6.

49ers general manager John Lynch said Foster will rejoin the team at OTAs tomorrow.

After the ruling, the Santa Clara County District Attorney released an official statement below (via Matt Maiocco):

“We are disappointed in the judge’s decision. We are disappointed because the evidence demonstrated that Mr. Foster seriously hurt his girlfriend. Some have wondered why we still think Mr. Foster hurt his girlfriend when she said that he didn’t. Recantation is common among domestic violence victims. Some are scared, some feel guilty, some are coerced, some need money. Whatever the cause, we move forward on cases when victims falsely recant because we know that if we don’t more victims will be hurt. Our commitment to domestic violence survivors is unwavering.”
